Welcome to RewardSmart! These Terms of Service ("Terms") govern your access to and use of the RewardSmart mobile application ("App") and related services provided by RewardSmart ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

RewardSmart provides credit card recommendation and reward optimization services. Our App offers:

• Personalized credit card recommendations based on merchants and spending categories
• AI-powered chat assistant for credit card questions
• Digital wallet to track your credit cards and their benefits
• Reward tracking and optimization suggestions
• Card finder quiz for personalized recommendations
• Price tracking and coupon finding features (Premium)

3. Account Registration

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

4.1 Free and Premium Tiers

The App offers both free and premium subscription tiers. Free tier users have access to basic features with advertisements. Premium subscribers ("Elite" tier) have access to additional features as described on our pricing page.

4.2 Billing

Premium subscriptions are billed annually at the current rate. All payments are processed through the App Store (Apple) or Google Play Store. By subscribing, you authorize recurring charges.

4.3 Refunds

Refund requests are handled according to the policies of the respective app stores (Apple App Store or Google Play Store). We do not directly process refunds.

4.4 Price Changes

We reserve the right to change subscription prices. We will provide notice of any price changes before they take effect.

5. Use of the App

5.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App or servers or networks connected to the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to transmit viruses, malware, or other harmful code
• Collect or harvest any information from the App without authorization
• Use automated systems (bots, scrapers) to access the App

5.2 User Content

You retain ownership of any content you submit to the App. By submitting content, you grant us a non-exclusive, royalty-free license to use, modify, and display that content for the purpose of providing our services.

6. Third-Party Services

6.1 Plaid Integration

Our App uses Plaid to connect to your financial accounts. By using Plaid integration, you also agree to Plaid's Terms of Service and Privacy Policy. We are not responsible for Plaid's services or data handling.

6.2 Other Third Parties

The App may contain links to third-party websites or services. We are not responsible for the content, terms, or practices of these third parties.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

7.1 Financial Advice Disclaimer

RewardSmart does not provide financial advice. Our recommendations are for informational purposes only and should not be considered as financial, investment, or credit advice. Always conduct your own research and consult with qualified financial professionals before making financial decisions.

7.2 Card Information Accuracy

While we strive to maintain accurate and up-to-date information about credit cards, we cannot guarantee that all information is current, complete, or accurate. Credit card terms, rewards, and benefits may change without notice. Always verify information directly with the card issuer.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Costs of substitute services
• Any damages arising from your use or inability to use the App

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless RewardSmart, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you submit to the App

10. Termination

10.1 By You

You may terminate your account at any time by deleting your account through the App settings or by contacting us. Subscription cancellations must be done through the respective app store.

10.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice.

10.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Telangana, India.

13. Dispute Resolution

Before filing a formal legal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and RewardSmart regarding the App and supersede all prior agreements.
