Welcome to RewardSmart! These Terms of Service ("Terms") govern your use of the RewardSmart mobile application (the "App") and related services provided by RewardSmart ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree to these Terms, you may not access or use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that:

  • You are at least 18 years of age or the age of majority in your jurisdiction
  • You have the legal capacity to enter into a binding agreement
  • You agree to comply with these Terms and all applicable laws and regulations

2. Description of Service

RewardSmart is a credit card rewards optimization application that:

  • Provides recommendations on which credit card to use for specific purchases
  • Tracks your credit card reward categories and benefits
  • Offers AI-powered assistance for credit card-related questions
  • Helps you discover new credit cards that may benefit you
  • Optionally connects to financial accounts via Plaid to analyze spending

Important: RewardSmart provides informational recommendations only. We are not a financial advisor, and our recommendations should not be considered financial advice. Always do your own research before applying for credit cards.

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

4. Subscription and Billing

4.1 Free Tier

RewardSmart offers a free tier with limited features. Free users may see advertisements within the App.

4.2 Elite Subscription

The Elite subscription provides access to premium features, including:

  • Unlimited credit cards in your wallet
  • AI Chat Assistant
  • Plaid transaction import
  • Ad-free experience
  • Detailed analytics and insights

4.3 Payment and Renewal

Subscription payments are processed through Apple App Store or Google Play Store. By subscribing, you agree to:

  • Pay the subscription fee at the rate displayed at time of purchase
  • Automatic renewal at the end of each billing period unless cancelled
  • Cancellation at least 24 hours before the end of the current period to avoid renewal

4.4 Refunds

Refund requests are handled through Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

5. Acceptable Use

You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction while using the App
  • Attempt to access, tamper with, or use non-public areas of the App
  • Interfere with or disrupt the App or its servers
  • Probe, scan, or test the vulnerability of the App
  • Circumvent any security or authentication measures
  • Reverse engineer, decompile, or disassemble the App
  • Copy, modify, or distribute the App's content without permission
  • Use automated means to access the App (bots, scrapers, etc.)
  • Impersonate another person or misrepresent your affiliation
  • Share your account credentials with others
  • Use the App to send spam or unsolicited communications

6. Intellectual Property

The App and its original content, features, and functionality are owned by RewardSmart and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our App or its content without our express written permission.

7. Third-Party Services

The App integrates with third-party services including:

  • Plaid: For connecting to your financial accounts
  • OpenAI: For AI chat functionality
  • Apple/Google: For authentication and payments

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

8. Credit Card Information Disclaimer

RewardSmart does not collect or store your actual credit card numbers, CVV codes, or expiration dates. We only store the names of credit cards you own for the purpose of providing recommendations.

The credit card information, reward rates, and benefits displayed in the App are based on publicly available information and may not always be current or accurate. We strive to keep our database updated, but cannot guarantee the accuracy of all information. Always verify details with the card issuer before making decisions.

9. No Financial Advice

RewardSmart is not a registered investment advisor, financial advisor, or credit counselor. The information and recommendations provided through the App are for informational purposes only and should not be construed as:

  • Financial advice
  • Credit advice
  • Tax advice
  • Legal advice
  • Investment recommendations

You should consult with qualified professionals before making financial decisions. We are not responsible for any financial outcomes resulting from following our recommendations.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF INFORMATION

We do not warrant that the App will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REWARDSMART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Financial losses from following recommendations
  • Credit score impacts
  • Denied credit card applications
  • Missed rewards or benefits
  • Service interruptions

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the subscription in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless RewardSmart and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit through the App

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Sending an in-app notification for significant changes

Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App will cease immediately
  • Active subscriptions will not be refunded
  • We may delete your account data

You may terminate your account at any time by deleting your account in the App settings.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.

You agree to waive your right to participate in class action lawsuits against RewardSmart.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
